1. Introduction

Welcome to Apex 3C ("Apex," "Company," "we," "our," or "us"). These Terms and Conditions ("Terms") govern the use of our coaching, counseling, and consulting services. By engaging with our services, you agree to abide by these Terms.

2. Services Provided

We provide professional coaching (executive, business, life, group, and team coaching), financial counseling/education, and consulting services to individuals and businesses. Our services are designed to support clients in achieving personal, professional, and financial goals.

3. Client Responsibilities

• Clients are expected to be honest, open, and engaged in the consulting and coaching process.
• Clients must ensure that all information provided is accurate and complete.
• Clients acknowledge that our services do not constitute legal, medical, or psychological advice.

4. Fees and Payment

• Fees for services are detailed in individual service agreements.
• Payment must be made as per the agreed schedule.
• Late payments may incur additional charges.
• No refunds will be issued once services have commenced unless otherwise agreed upon.

The coaching schedule will be arranged between the Coach and the client. Apex will recommend the frequency of coaching sessions based on a professional assessment of the client’s requirements. This recommendation is not binding and may be altered and adjusted throughout the coaching journey by mutual agreement.

Where no specific number of sessions is agreed, services will be provided on a session-by-session basis. Participation in the first coaching session constitutes acceptance of these terms and conditions.

5. Format of Sessions

Sessions are conducted via phone, Skype, Zoom, FaceTime audio, WhatsApp audio, or other agreed-upon methods. Clients are responsible for calling the coach unless otherwise agreed.

6. Session Fees

Apex’s current fees are stipulated on the website and are made clear at the time of booking. Any payments for sessions paid in advance are honored even if prices change before the session occurs.

7. Dates and Times of Sessions

Session schedules are maintained via an online booking system. Apex commits to honoring booked sessions.

8. Payment Terms

Payments can be made via credit/debit card, PayPal (via Stripe), or other agreed-upon methods. Fees must be paid in advance unless stated otherwise. Late payments may incur additional fees.

9. Between Sessions

Clients may be assigned tasks between sessions. Additional coaching or support between sessions may incur an extra charge.

10. Rearranging Sessions

Clients must provide at least 48 hours' notice to reschedule a session. Unused sessions without prior notice are non-refundable.

11. Confidentiality

All client information shared during sessions is confidential unless disclosure is required by law or necessary to prevent harm.

12. Early Termination

Apex may terminate services under exceptional circumstances (e.g., illness, inappropriate behavior, or conflict of interest).

 Clients will be notified and refunded for unused sessions.

13. Responsibilities

Apex provides guidance and recommendations, but clients remain responsible for their personal and professional decisions.

14. Variation of Terms & Conditions

Apex reserves the right to modify these terms with one week's notice. Clients can discontinue services if they disagree with new terms.

15. Governing Law

These terms are governed by the laws of Fairfax County, Virginia, USA, with exclusive jurisdiction over disputes.

16. Data Protection

Client data is handled with confidentiality, subject to legal requirements.

17. Data Security

Clients acknowledge the potential risks of digital communication and accept these risks.

18. Waiver & Limitation of Liability

• We do not guarantee specific outcomes from our services.
• We are not liable for direct, indirect, or consequential damages arising from service use.
• Clients release Apex and its representatives from any claims related to services provided.

19. Termination of Services

Either party may terminate services with written notice per the service agreement. Fees for completed services remain due.

20. Intellectual Property

All materials provided by Apex remain the intellectual property of Apex and cannot be copied, shared, or reproduced without permission.
